MyVetPH Application: Privacy Policy

This Privacy Policy (the “Policy”) explains how we, the MyVet App (“we”, “us” or “our”) company number (company number) and registered office (Office address) gather and use your personal data in the course of our service, including via the myvet.com website (the “Site”) and the MyVet App (the “App”) from our iOS, Amazon and Android applications.

This Policy can be changed at any time and we will inform you of any revisions to this Policy. After we have issued warning, the modifications will refer to your use of the Website and/or App (as applicable). You cannot continue to use the website and/or app if you do not want to follow the revised rules (as applicable). If you intend to use the Web and/or App (as applicable) after the effective date of the update, the use of the Site and/or App (as applicable) would mean that you have decided to be bound by the new Policy.

This Policy was last changed in (February 2021).

1. Background

          1.1 We, the MyVet App, are controllers of data. Contact us at (contact number) or (website/email address).

          1.2 Our Data Protection Officer, (Name of officer), can be contacted at (Office Address), (Contact Number) or (Website/Email).

2. Your use of the site

          2.1 Information collected when you use the Service: If you want to contact us via the Site to book or sign-up to use our App, we can collect the following information from you via the Site, including your name, e-mail address, business name, job description, clinic details and website details of the clinic, along with any other contact details you may provide to us, such as your phone number.

         2.2 Processing ground: To gather the pieces of information mentioned in 2.1, we depend on the contractual requirement processing ground. In regards to you contacting us above, as this information is needed in order for us to register you as a customer and/or book a demo (if applicable). We depend on consent in regards to our use of cookies, because we ask you to consent to our use of cookies when you first visit the website.

         2.3  How to use your information on the Site: Information about you as defined in paragraph 2.1. They’re used by us:

                    2.3.1 to book you as a customer for a demo and/or sign you up; and

                    2.3.2 to assess and enhance the efficiency of our website, such as using Google Analytics to watch who visits our website and how they access the sites.

3. Your use of the App

         3.1 Information that our App collects: When you use our App, we can collect the following information:

                   3.1.1 If you are a customer of our veterinary clinic, the company name and e-mail website, the address and telephone number of your veterinary clinic.

                   3.1.2 If you are an employee/contractor of a veterinary clinic, i.e., an end customer of the veterinary clinic currently using the Software, we will collect your name (whether given to us by the vet clinic itself or by you inputting such details directly or signing-up via Google, Facebook or Apple), email address, work position and name of the associated clinic from you. We will then check these information (including, for example, with a suitable RCVS registration entry) and allow you to view and use the Software until checked.

                   3.1.3 If you are a pet owner, the name and e-mail address that can be sent to us are as follows: (i) your name and e-mail address as provided directly by you to us if you want to sign up for the App (either by entering those information directly or through signing up through Google, Facebook or Apple); or (ii) your name and telephone number, as indirectly provided to us by your veterinary clinic for your veterinary clinic or by us, as instructed by your veterinary clinic, to invite you to join the App. Upon registration, we will collect additional information from you, including your e-mail address or phone number (as applicable), post code, and details about your pet, in addition to the information provided directly or indirectly to us as mentioned above (such as their type, gender, breed, date of birth, weight and whether they are neutered or not). Some of these details may already be pre-populated by your veterinary clinic if you sign up indirectly under c(ii), but we would advise you to carefully check and edit them as needed.

                  3.1.4 If you are an end-user or pet owner of a veterinary clinic using the App, we will also record the appointment if you make an appointment via the App. Obviously, the nature of what is recorded depends upon the nature of the appointment itself.

          3.2 Processing ground: In order to process the personal data items alluded to in paragraph 3.1, we focus on contractual necessity. Since we need those data to license the App to you, above. Exceptions are: (a) the data collected under c(i) if we use those data for the purpose of sending you e-mail marketing addresses, in which case we can only do so if we have your consent; (b) the data collected under c(ii) in relation to such data, we are a data processor and thus based on whatever data processing ground your veterinary clinic relies on to allow us to process your data on their orders; and (c) the data collected under (d) When we focus on legitimate interests because, for our own professional obligation and regulatory purposes, we need such details, and to further our business purpose and the collection and retention of such data by us does not outweigh your rights and freedoms as an individual given that the App is a virtual appointment based application and you are informed that we record such data before you take part in the applicable appointment and the nature of such data collected and retained by us merely relates to the particular appointment in question and is hence not particularly sensitive personal data.

          3.3 How to use your information on the App: Information about you as defined in paragraph 3.1. The following can be included by us:

                    3.3.1 to allow us to conduct administrative tasks related to the management of the App and to provide you with the services we provide via the App, i.e. to allow you to electronically attend and access veterinary appointment services;

                   3.3.2 to, if you agree and/or have given such consent to your veterinary clinic (or, where otherwise allowed under electronic marketing law), send you electronic marketing notifications in relation to products or services that we feel might be of interest to you;

                   3.3.3 to tweak, tune and facilitate the improvement of the App;

                   3.3.4 to have technical assistance and troubleshooting in relation to the use of the App;

                   3.3.5 to prevent fraud or illegal activities;

                   3.3.6 to use those knowledge in an anonymized form for our own research and marketing purposes; and

                   3.3.7 to share with third parties as described in paragraph 3.4 below.

        3.4 Sharing of information with third parties: We cannot pass the information to any third party (other than as described in this paragraph). Your information should be exchanged with the following third parties, subject to our duty to comply with relevant data security regulations:

                  3.4.1 Different external service providers, including AWS, Twilio, Stripe, Elastic Cloud, Practice Management System providers and Auth0, are interested in delivering services for us;

                 3.4.2 If you are a pet owner or end-user of a veterinarian clinic who want to sign up with us through such sites, Google, Facebook and/or Apple;

                 3.4.3 We will share this information with our regulator after having taken measures to ensure the security of such information.;

                 3.4.4 We may share the details in an anonymized form with: (i) any third party in relation to the sale of any or all of our company or its properties, or as part of any merger or reorganization of the business. We will take action to ensure that your interests continue to be secured if, in compliance with this clause, your personal data is transferred; or (ii) law enforcement authorities in compliance with law enforcement.

          3.5 Links to third-party websites and ads by third parties: We are not responsible for the privacy policy and procedures of such sites, even though you use links from the website or software to access them. If you have any complaints or inquiries, you can verify the policies of each site you visit and contact its owner or operator. In addition, whether you connect to a third-party website or software from a third-party website or from a social network (e.g. Twitter), we are not responsible for the privacy policy and practices of the owners or operators of that third-party website and suggest that you review the policies of that third-party website and, if you have any questions or complaints, contact its owner or operator.

          3.6 Security: To safeguard your privacy from unwanted access and inappropriate use, we have introduced technologies and policies.

          3.7 Storage and Data Retention: Your data is processed by us in the EEA by our third-party storage provider (name of storage provider, e.g. AWS) for as long as we feel it appropriate to store it in order to be able to supply you with our services. This is also usually the amount of time during which you are engaged by us (if you are a customer of  a veterinarian clinic or veterinary clinic) or your clinic is engaged by us (if you are a pet owner). The exception to this is the appointment-related data that we retain for 7 years in compliance with the regulatory obligations applicable. Data outside the EEA may be processed by our other third party providers and we have reasonable contracts in order to guarantee the adequacy of any transition. You may order the withdrawal of your details at any time by e-mailing us at any time (email ex. Myvet.com).

         3.8 Your Rights: If you want to: (i) access a copy of the personal data we hold about you; (ii) correct any pieces of personal data we hold about you; and/or (iii) have any items of personal data that we hold about you erased or object to our processing of those items of personal data, you can contact us using the information set out above. You can, at any time, contact the ICO.
