These Terms of Operation (hereinafter referred to as “Terms”) represent a contractual legal arrangement between you and (MyVet), with the business number (number) and registered office address (address) (“MyVet,” “we,” “us” and “our”). Together with our smartphone apps, tools and programs for pet owners and veterinarians to locate each other and connect, they monitor your use of our website (myvet.com) (the “Site”).
You accept these words by visiting or using the Site OR (MyVet). If you do not comply with these terms, you do not recognize them, in which case you do not have the right to use the platform or (MyVetPH).
You understand and agree that we may change the Terms and that any such changes will be effective immediately when we post the modified Terms on the Site and/or (MyVetPH). Your continued access and use of the Site and/or (MyVetPH) after we post the modified Terms will constitute your consent to be bound by the modified Terms.
The MyVetPH consists of a smartphone application, a website, and support and resources that can be used to identify and communicate with each other by pet owners (‘pet owners’) and providers of pet health care services (‘service providers’). The MyVetPH provides our aid resources, service providers’ training materials, and other services, including providing services for veterinarian appointments. For other parts of the MyVetPH, such as subscriptions for some MyVetPH functions, we charge fees if you are a service provider.
The MyVetPH is a neutral forum for service providers and pet owners and, with the exception of phone support and other tools and help explicitly listed in the MyVetPH, it does not include pet health services. Service providers listed on MyVetPH are not under the supervision or control of MyVetPH and decide what pet healthcare services to provide, how to deliver those services, and when to make themselves available to do so at their own discretion. There are no assurances or guarantees for the pet wellness care offered by service providers (“Pet Care Services”), or about your experiences and user relationships. Service Providers or Pet Owners are not employed by MyVetPH, and we would not be responsible for the results or actions of service providers or pet owners. It is the duty of pet owners and service providers to make choices that are in the best interests of themselves and pets. Before contacting a service provider, providing services, or otherwise communicating with pet owners or service providers (as applicable) through the MyVetPH, you should exercise your independent judgement.
The MyVetPH may be used to locate and provide Pet Care Services and to facilitate payment, but between Pet Owners and Service Providers are all transactions performed through the MyVetPH. With the exception of restricted returns, you accept thatMyVetPH is not responsible for any losses caused by Pet Care Providers (which may include bodily injury to, or death of, a pet) or arising from any other purchases between MyVetPH users.
MyVetPH does not support other Pet Owners’ reviews of service providers that might be accessible via the MyVetPH, and MyVetPH makes no promise that those reviews are correct or valid.
You confirm that you: (1) are 18 years of age or older, and (2) can comply with all laws and regulations related to the use of the MyVetPH by downloading and using the MyVetPH.
For Service Providers, this ensures that you are lawfully qualified to offer veterinary services within the (Country, e.g. UK) as a current (e.g. UK-practising member of the Royal College of Veterinary Surgeons), you have complied with and will comply with all relevant laws and regulations and have received all requisite business licenses and permits.
You agree that MyVetPH is entitled to rely on these responsibilities from you, though MyVetPH screens for compliance, it is not responsible or liable for the inability of a customer to comply with these eligibility requirements.
When you use the MyVetPH, you agree: To use the MyVetPH only lawfully and exclusively for its intended purposes, in particular not to alter it or any component thereof, to build or resell any derivative version thereof, or to make use of any data mining, data robots or related resources.
Not to send to or via the MyVetPH viruses or other malicious code.
Not to use the MyVetPH or to communicate with other MyVetPH users for reasons that are in violation of the law.
Not to post reports of service providers that are not based on your own experience, that are deliberately misleading, or that break these terms.
Not to post obscene, insulting, harassing, violent, or defamatory content or materials including pornography or graphic abuse, encouraging violence, infringing intellectual property rights, or violating others’ laws or civil rights (for example, privacy rights).
Not to publish “spam” or other unauthorized advertising messages
Not to pass or to allow some other user to use your account for the MyVetPH.
Not to demand the username and password of another user for the MyVetPH.
Not to have misleading information on, or register with, the MyVetPH in your profile.
Not to impersonate some other person.
Not to mess with our provision of the MyVetPHor any other user’s usage.
You understand and accept that MyVetPH has no responsibility to provide you with the MyVetPH service, nor any duty to continue to provide it after we have started. If we deem your actions to be unacceptable, dangerous or in breach of these terms on any of our platforms and for any other reason (or no reason at all), we reserve the right, in our absolute discretion, to revoke or terminate your access to the MyVetPH.
ou would be expected to create a username, password, and user profile to use the MyVetPH.You promise not to imitate someone else and not to keep more than one account (or, if MyVetPH terminates your account, not to create further accounts). You are responsible for keeping your MyVetPH username and password private, and you consent not to allow your username and password to be used by someone else. You are accountable for all activities under your account. You promise to remind us of any improper use of your account promptly.
This Policy can be changed at any time and we will inform you of any revisions to this Policy. After we have issued warning, the modifications will refer to your use of the Website and/or App (as applicable). We may request or allow you (or someone else on your behalf) to upload to the MyVetPH (collectively, “Your Content”) text, photographs, videos, feedback, information and materials. Service providers, for example, are invited to create a profile page containing an image and other material, while pet owners may request service provider feedback.
We reserve the right to track, view, edit and/or delete the content as considered necessary on the MyVetPH. Our implementation of these Terms relating to Your Content is at our discretion, and failure in one instance to enforce the Terms would not create a concession of our right in another instance to enforce them.
You agree that, in compliance with relevant legislation and our Privacy Policies, reviews can be exchanged with third parties and that MyVetPHhas no duty to retain or permanently store such reviews. We shall have no responsibility for any deletion, disclosure, failure or alteration of these reviews to you. We also reserve the right at any time to track, edit or delete these reviews from the MyVetPH.
MyVetPH retains all intellectual property and exclusive interests in MyVetPH and associated technologies, applications, documents and content, or is otherwise the approved licensee. MyVetPH gives you a limited, non-exclusive, non-transferable, worldwide license in compliance with these Terms to use and use MyVetPH. Nothing in these Terms licenses or conveys any of our intellectual property or proprietary rights to others, even you, except for the above. You also accept our eternal right to use and implement, without the condition of fee, any advice for change that you may have on the MyVetPH.
The rights to and to trademarks, service labels, corporate names and logos (the ‘MyVetPH Marks’) are held by MyVetPH. If you are a Service Provider, MyVetPH gives you a restricted, revocable, non-exclusive, non-transferable license to use the MyVetPH Marks for as long as you are in good standing on the MyVetPH.
The “as is” and “as available.” details and materials found on the MyVetPH, including text, graphics, images, links or other things, are provided. Reviews, profiles, advice, thoughts, statements, deals, or any material or materials made available through the MyVetPH, but not specifically through the MyVetPH, are those of their own contributors and are ultimately responsible for the content, and the related services offered to pet owners by the service providers. MyVetPH does not: (1) guarantee the authenticity of information and/or materials on the MyVetPH; (2) take responsibility for any opinion or comment made by any party other than MyVetPH; and/or (3) warrant that your use of the MyVetPHwill be secure, free of computer viruses, uninterrupted, always available, or error-free to the fullest extent permitted by applicable law.
To the degree allowed by applicable statute, MyVetPH expressly disclaims all guarantees and conditions with regard to MyVetPH, including express, implied or legislative, including all implied warranties of acceptable standard or fitness for function. In fact, MyVetPH does not guarantee the suitability of any service provider of any kind.
MyVetPH shall only be liable to you in respect to the compensation for injury or harm which is the probable outcome of the violation of these Terms by MyVetPH. MyVetPH shall in no event be liable to you for any unforeseeable loss or damage or for any resulting loss or for any commercial loss or loss of revenue, contracts, data or other similar loss in connection with your access to and use of MyVetPH, except where prohibited by applicable law. MyVetPH serves as an intermediate service provider at all times and merely promotes the relationship through the MyVetPH between a service provider and a pet owner.
If, when using the MyVetPH, you have a conflict with a Service Provider or Pet Owner, you agree that MyVetPH is not responsible for settling the dispute and that you must first attempt to settle the dispute with the appropriate Service Provider or Pet Owner.
In no case will MyVetPH be responsible for the actual or unintentional effects of failure to comply with rules, legislation, municipal by-laws and codes of conduct applicable to you by a pet owner or service provider. If we have damaged digital content that hurts a device or any digital content that belongs to you and we have not applied our proper expertise and treatment, we will refund you or restore the device or content (at our election). We would not be responsible for any loss or harm arising from flawed digital material if you have not followed our guidelines for use or guidance in these Terms
All sales are final and is non-refundable. This applies to all subscriptions plans availed in the MyVet System and MyVetPH. In the event that you would want to change your subscription, you are only allowed to upgrade your plan or choose to extend it.
